WEDDING CONTRACT AGREEMENT

1. This agreement constitutes an order for wedding portraiture services, including the taking of wedding photographs as agreed to by both parties. The studio and contracting party (client), unless otherwise specified, it is understood that any and all rights to proofs , final or sample prints, thereof shall remain the property of the studio and may be used for advertising, display, or any other purpose deemed proper by the studio. The studio / photographer and assistants will be held harmless and not liable for the event of the church, or other wedding venue, and / or minister’s policies regarding, or limiting the photographing during the wedding ceremony. Unless otherwise specified, it is understood that any and all rights to proofs, sample or final proofs, sample or final prints / digital media, released to client, are shared with the studio, and may be used for advertising, display, or any other purpose deemed appropriate by the studio.

2. If the photographer cannot perform this agreement in whole or in part due to fire or other casualty, acts of God or nature or terror, or other cause beyond the control of the parties, or due to photographer’s illness or injury, then the studio shall return all fees to the client(s) but shall have no further liability with respect to this agreement. This limitation on liability shall also apply in the event that photographic materials are damaged in processing, lost through camera malfunction, lost in the mail, or otherwise lost or damaged without fault on the part of the photographer. Client(s) also agree that an entire wedding cannot be replicated, reenacted, or repeated for the purpose of a re-shoot and limits the studio’s liability to the amount paid under this contract.

3. It is understood and agreed that no other photographer will be allowed to take photographs during the wedding ceremony and formal portraits session, while the photographer is working. Photographer shall not be held liable for missed photos or opportunities caused by guest or non studio sanctioned photographer interfering with the hired photographer while working. There shall be no restrictions for disposable cameras provided at reception by client(s) for the guests.

4. On signing of this agreement by both parties hereto, the studio shall reserve the time and date agreed upon and shall not make another reservation for that specific date and time frame. For this reason, deposits are nonrefundable even if the date is changed, or if the wedding is cancelled or postponed for any reason.

5. Client acknowledges that the photographer's work is primarily documentary / photojournalistic in nature—focused on authentic storytelling and genuine unscripted moments; rather than posed or heavily directed imagery. A brief time will be set aside for a few family and group portraits, as requested by the client in advance. The overall flow of the day will be captured candidly and naturally. Photographer maintains creative control over how the day is captured, and how post-production is done—consistent to signature brand. Client understands that the photographer's ability to document genuine, authentic moments will depend on being able to work without interference or direction during the event. To preserve authenticity, clients, guests, family, or wedding parties should not direct or stage scenes that could interfere with the creative process and storytelling consistency. Photographer cannot be held responsible for missed moments or results outside of this approach due to interference or requests to deviate from it. 

6. A 50 percent retainer fee is due at the signing of this agreement, with a further payment of all necessary expenses, unless otherwise specified, such as parking, travel / fuel allowance, taxi, hotel charges, etc. The balance due is to be paid 7 days prior to the event. No photography will take place and no rights will be granted until timely payment is made in full. Late payment fees may apply. The fee is non-refundable in case of cancellation or date change by client. Proofs or other form of desired media shall be ready to promptly deliver to client, within 30 days from the date of the event.

7. Your images will be delivered in JPEG format on a USB. RAW format is not available for purchase, they are proprietary image file formats created by high end digital cameras. These files have not been interpolated by in-camera software and as such still contain all the data captured by the camera’s photosensitive chip at the moment of exposure. They cannot be read or displayed by anything other than dedicated imaging software. We use them for the immense flexibility they give us in preparing the highest quality delivery images. Raw files need special equipment and extensive knowledge to get the best results. We do not release the RAW files to clients that are professional photographers as well. The client is not to use the JPEG images provided by Jay Farrell Photography for anything but print purposes and online sharing. Jay Farrell Photography retains the copyright of the images and the client is not to alter or edit those images in any way. All images will be edited for color correction, tone and contrast. Any image in the album will be edited for skin blemishes as well as exit sign removal if present in the image and minor flyaway hairs. Liquefying and all other edits are an additional cost.

I / We the undersigned contracting party, hereby warrant that I am / We are competent to contract in my / our name(s). I / We confirm that I / We have read the herein agreement prior to its execution and I / We are familiar with the contents thereof. This agreement shall be binding upon us and our heirs, legal representatives and assigns.
